Of all the liability surfaces AI is creating in emergency medicine, discharge instructions may be the most underestimated. The note you sign at the end of the encounter—what the patient goes home with, what the family reads, what the plaintiff’s attorney subpoenas—is increasingly being generated or modified by AI. And most emergency physicians have not thought carefully about what that means.
What follows is not legal advice. It is a clinician-to-clinician analysis of an emerging documentation liability problem, written so you can address it before it becomes your personal exposure.

The Discharge Instruction as a Legal Document
Discharge instructions occupy a specific medicolegal space in emergency medicine. They document what you told the patient, what you expect them to do, and when you expect them to return. In malpractice litigation involving missed diagnoses—ACS, PE, appendicitis, ectopic pregnancy—discharge instructions are routinely reviewed to establish what the patient was told and whether the standard of care for return precautions was met.
When you sign AI-generated discharge instructions, you are attesting to their accuracy and appropriateness in the same way you attest to an AI-generated clinical note. The legal ownership is identical. The risk profile is not.
When AI Gets Discharge Instructions Wrong
AI discharge instruction generators draw on template libraries and NLP processing. They can produce technically fluent documents that are clinically wrong for your specific patient. Common failure modes include instructions written at reading levels inappropriate for the patient population, return precautions that do not match the actual diagnosis or clinical trajectory, medication instructions that conflict with the ED-prescribed regimen, and follow-up timelines that ignore local access realities.
None of these errors necessarily flag themselves. The instructions look complete. They are formatted correctly. They have all the right sections. The physician who signs without critical review has accepted legal responsibility for a document they did not substantively author.
The Follow-Up Failure Problem
Return precaution failures are one of the most common litigation triggers in emergency medicine. “The patient was never told to come back if the pain worsened” is a claim that discharge instructions can refute or confirm. When AI generates discharge instructions, the accuracy of that documentation becomes dependent on both the quality of the AI output and the quality of the physician’s review.
The plaintiff’s argument in future cases will not require proving the AI made an error. It will require demonstrating that the physician did not adequately review the AI output before signing. That is a lower bar than proving specific clinical error—and it is a bar that will be easier to clear as AI documentation tools become standard practice.
What You Should Be Doing Now
• Review AI-generated discharge instructions with the same clinical cognition you apply to AI-generated notes. Confirm that the return precautions match the actual clinical picture. Verify that medication instructions are accurate. Adjust the reading level if your patient population requires it.
• Know what AI tools are generating discharge instructions in your department and whether those tools have been validated for the diagnoses you treat. A tool validated for chest pain rule-out may not produce appropriate instructions for the orthopedic presentations you also manage.
• Establish a documentation standard for your department that specifies physician review requirements before AI-generated discharge instruction attestation. This is a patient safety and liability issue, not an efficiency issue—frame it accordingly.
• If your department does not have an AI governance process that covers documentation tools, initiate one. Emergency physicians who are present in these governance conversations will shape the standards. Those who are absent will inherit them.

Discharge instructions are the last clinical act of the encounter, and they carry significant liability weight. I have reviewed malpractice filings where the entire case turned on what the discharge instructions said—or failed to say—about return precautions. When an AI generates that document and I sign it without critical review, I have accepted legal ownership of every error it contains. That is not a theoretical risk. It is the current standard of care question that risk management teams are just beginning to articulate. In my programs, any AI-generated patient-facing document requires an explicit attestation workflow—not just a signature. The field needs to adopt that standard before the litigation does it for us.
